General terms and conditions of sale

These general terms and conditions of sale (hereinafter referred to as "GTC") shall apply to sales transactions entered into by My Landin (hereinafter referred to as "the Company") with the customer.

The customer acknowledges that he/she has the capacity to enter into a contract, i.e., that he/she has reached the age of majority and is not under guardianship or trusteeship.
The client also declares to use the site in accordance with these GTC, in his name and in the name and for all the beneficiaries of the services ordered by him on the site for which he acknowledges to be the representative (hereinafter: "the beneficiaries") and to whom these GTC will be enforceable.
The customer is financially responsible for the use of the site made in his name as well as for the beneficiaries, unless he can demonstrate fraudulent use not resulting from any fault or negligence on his part.
The client guarantees the truthfulness and accuracy of the information he/she provides in his/her name and in the name and on behalf of all beneficiaries using their data on the site.

The Company reserves the right not to enter into a contract at any time with a Client who makes fraudulent use of the Site or who contravenes these Conditions.
In this regard, we remind you of the terms of Article 313-1 of the French Criminal Code:
"Swindling is the fact, either by the use of a false name or a false capacity, or by the abuse of a true capacity, or by the use [...] of fraudulent practices to deceive a natural or legal person and thus determine to his detriment or to the detriment of a third party, to hand over funds, securities or any other property, to provide a service or to or to discharge himself. Swindling is punishable by five years imprisonment and a fine of 375 000 €.

Pursuant to the provisions of Article L 121-21-8 of the Consumer Code, the services offered on the Site by the Company are not subject to the application of the right of withdrawal provided for in Articles L. 121-21 et seq. of the Consumer Code in the context of distance selling.
Consequently, the services ordered on the Site are exclusively subject to the conditions of cancellation and modification provided for in the present General Conditions and the General Conditions of Sale modification provided for in the present Conditions and the Customer cannot avail himself of the right of withdrawal.

The prices are expressed in euros. VAT is included in the proposed prices. Any change in the applicable rate, or any modification or introduction of new legal charges introduced by the competent authorities, will automatically be reflected in the prices indicated on the date of invoicing.
The rates are per room for the number of persons indicated and the period chosen. The prices mentioned on the Site may be modified at any time by My Landin without prior notice. Only the price indicated in the Company's reservation confirmation is contractual.
No stay booked prior to the implementation of a promotional offer will be refunded, even for one-way trips.

When placing an order, the Client must
- Fill in the identification form on which he/she will indicate all the requested details or give his/her customer number.
if he has one,- Fill in the online order form giving all the references of the products or services chosen,- Validate his order after having checked it,- Make the payment in the conditions provided and confirm the order and the payment.- In case of booking more than 5 rooms, different policies and additional charges may apply.Please contact the reservation department at 33 6 80 58 38 71 or by mail indicating the email address
Confirmation of the order implies acceptance of these terms of sale, acknowledgement of having full knowledge of them and waiver of its own conditions of purchase or other conditions.
All the data provided and the recorded confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.
The Company will send to the Client, by any means (e-mail), the confirmation of the registered order.
The reservation is firm and final only after receipt of the confirmation sent to the Client by the Company. The rates, terms and conditions of reservation are intended for the sale of rooms and Gîtes on the basis of their initial use (accommodation). My Landin reserves the right to modify the rates, terms and conditions, or simply to cancel the reservation, if the rooms or cottages are used for other purposes such as photo shoots, film shoots, showroom, or interview...

Depending on the type of reservation made, the price is payable in full at the time of placing the order. In all cases and in order to guarantee the reservation, the Customer is invited to communicate his credit card number, the transmission being done by secure mode.
In the event of payment at the time of placing the order, the credit card information transmitted by the Client via a secure system to the Company allows the latter to debit the card for the total amount of the stay, always in a secure manner. The Client's bank account is debited on the day the order is placed, and the invoice is sent by the Company to the Client on the day of departure from Château du Landin.

In the case of accommodation with a third party, My Landin will require documents for the security of the transaction. 

Cancellations and/or modifications of reservations may be authorized depending on the price plan chosen by the Client. In case of option for a flexible plan, any request for modification and/or cancellation of a reservation must be made within the following deadlines and at the latest
- 7 days prior to the Client's arrival date, Refund of reservation;- Less than or equal to 7 days, depending on the duration :

o For one night in a room, the amount will not be refunded;o More than one night, 50% of the amount of the reservation will be retained.
The date of receipt of the request for modification and/or cancellation (by e-mail) is the date retained for the cancellation (less than 7 days).
In the event of the Client's failure to show up at My Landin and in the absence of a cancellation, the total amount of the reservation will be retained by My Landin;
In addition, for a stay of at least two nights, in the event of no-show by the Client on the first day of the stay, My Landin is not obliged to keep the room for the rest of the stay.

The Client is requested to plan an arrival before 8:00 p.m. and to inform My Landin in case of late arrival, under penalty of being considered as not having arrived on the first day of the stay.

On the day of departure, the rooms or cottages must be vacated before 12:00 noon.

In the event of My Landin's unavailability or in the event of force majeure, My Landin shall refund the entire reservation.
My Landin may not be asked to pay any additional compensation.

Orders for additional services and/or packages may only be placed at the same time as the reservation of a stay at the establishment on a given, predetermined date.
They can only be used by the Client during his stay at the Château du Landin. They may be modified and/or cancelled under the conditions of article VII hereof.

Force majeure refers to any event external to the parties, both unforeseeable and insurmountable, which prevents either the customer or My Landin from fulfilling all or part of the obligations under the contract. This shall apply in particular in the event of strike, insurrection, riot or prohibitions issued by governmental or public authorities.
It is expressly agreed that force majeure suspends, for the parties, the performance of their mutual obligations and that each party bears the costs arising therefrom.
In particular, Customers shall bear the additional costs that may be incurred to allow the continuation of the trip, following the occurrence of a case of force majeure.

All claims must be addressed to the following address My Landin 23 rue d'Anjou 75008 PARIS, within 15 days following the departure of the trip that is the subject of the complaint. After this period, no claim can be taken into account.

In application of the French law 78-17, called "informatique et libertés", customers are informed that their reservation is subject to computerized personal data processing. Customers have the right to access and rectify the data entered, which can be exercised at the head office: My Landin 23 rue d'Anjou 75008 PARIS. It is specified that this information is not communicated to third parties.
The Company offers wifi Internet access. The Customer agrees that the computer resources made available to him shall not be used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or by a related right, such as texts, images, photographs, audio-visual musical works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorization is required.
In the event of photos, political or pornographic indications that may affect the image of Château de Landin, its space or its owners, employees or any other customer, on our various sites (Facebook, Instagram...), or any other medium, not authorized, My Landin reserves the right to take legal action against the persons responsible for the offence.

The Company declines all responsibility in case of theft, loss or deterioration of clients' property during their stay.
The client shall be held responsible for any damage, deterioration or vandalism that may occur as a result of the occupation of the premises and/or by the participants and/or by the staff in their charge, whether or not the decoration and property belong to My Landin. Consequently, the Company is entitled to ask the Client to leave the establishment without any compensation or refund of the current stay, and to reimburse any damage caused by these acts.
In the event of non-compliance with the staff, My Landin shall be entitled to ask the Client to leave the establishment without any compensation or refund of the current stay, and to reimburse the damages caused by such acts.
In the event that an accommodation is rendered unclean, My Landin shall be entitled to charge the Customer a fee for restoring the premises.
In the online sales process, the Company is bound only by an obligation of means. It shall not be liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, service interruption or other unintended problems.

The present general conditions of sale are governed by French law. It is so for the rules of substance as for the rules of form. Disputes will be under the exclusive jurisdiction of the French courts.
